This limited warranty pertains to the loose rubber mulch products produced by Mahantango Enterprises, Inc. (“Manufacturer”), which includes RubberLast™ Mulch and RubberLast™ Play Turf (collectively hereinafter “Product”). This limited warranty applies only to the original purchaser(s) of the said Product and to Product purchased through an authorized retailer and/or vendor. Manufacturer warrants that the RubberLast™ Mulch is ninety-eight (98%) steel free and that RubberLast™ Play Turf™ is ninety-nine and nine tenths (99.9%) percent steel free. Further, Manufacturer warrants that the Product will retain a minimum of fifty (50%) percent of its color for a period of ten (10) years from the date of purchase.

This limited warranty expressly does not cover any damages and/or deterioration of the Product caused or resulting from any of the the following: (i) failure to strictly adhere to the Manufacturer’s installation and maintenance instructions located on the bag and this website; (ii) any alteration or other misuse of the Product, which shall specifically include any use other than that which has been expressly stated on the Product’s packaging and/or this website; (iii) where the Product are not used under normal conditions or are subject to abnormal weather exposure; (iv) any negligent or accidental acts of Purchaser(s) or third party; (v) any damage caused to the Product during shipping; (v) discoloration caused by the Product’s exposure to chemical, bleaches or other similar cleaning agents, pesticides or fertilizers, and; (vi) disasters including but not limited to fire, flood, wind or lightning. Any alteration of the Product or use other than specified will void the warranty. All claims must include the original receipt/invoice, a sample of the Product, a brief explanation of the issues, and must be received with ten (10) years of date of purchase. Manufacturer will not honor a warranty claim if the product in question has been disposed of by the purchaser(s) or any third party prior to inspection by Manufacturer. Upon verification, the Manufacturer will, at its option, refund the purchase price paid or replace defective Product covered by this warranty, without charge to the original purchaser for replacement materials only within the aforementioned warranty period. Any and all labor costs shall be excluded.

This warranty is limited to the purchase price of the Product and does not include any incidental or consequential damages, installation or removal costs/expenses, or shipping charges. All costs of shipping and freight associated with making a claim under this limited warranty shall be borne by the claimant. Claims must be sent to:

DISCLAIMER OF IMPLIED WARRANTIES/LIMITATION OF REMEDIES: BY OPENING A PACKAGE CONTAINING THE PRODUCT, THE CUSTOMER AND PURCHASER OF THIS PRODUCT AGREES THAT THE SOLE AND EXCLUSIVE REMEDY FOR ANY DEFECT IN THE PRODUCT OR DAMAGES THEREFROM SHALL BE RESTRICTED TO THE LIMITED WARRANTY FOR THESE PRODUCTS. THE MANUFACTURER HEREBY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ALL OF WHICH ARE HEREBY EXCLUDED TO THE FULLEST EXTENT ALLOWED BY LAW. NO WARRANTIES WILL APPLY AFTER THE LIMITED WARRANTY PERIOD HAS EXPIRED.
